TEMPLE was a farmer in San Augustine, San Augustine, TX.6832 He involved in a shootout over a land dispute on 1 April 1840 in San Augustine, San Augustine, TX.45965 Noble, Harry P., Jr. Texas Trailblazers: San Augustine Pioneers (Lufkin, TX: Best of East Texas Publishers, 1999), pp. 20-25: Eight days later, on April Fool's day, the San Augustine lawyer's life would change drastically. Judge Branch would order thirty-six talismen from which to select a jury to try William G. Anderson for murder. Earlier, on a hot Saturday morning. August 10. 1839. Four men rode 10rth out of San Augustine. Although they were armed, it was a peaceful mission-they were going to meet with John Bodine to settle a dispute over land boundaries. The four riders were William G. Anderson, Alexander Horton, Hershal Corzine and Lewellyn A. Temple. Although they were unaware of it, death rode with them. Alexander Horton, age 29 at that time, had recently married Elizabeth Cooper Lattin and the couple. With their new son, Sam Houston Horton, lived a few miles south on Moral Creek. Horton had recently acquired a tract of land along the Ayish Bayou a little more than two miles north of San Augustine. After the purchase he found that some of the acreage appeared to overlap a segment of a half league John Bodine had claimed for fifteen years. It's likely Anderson was along as Horton's legal counsel, having represented him on previous occasions. Temple and Anderson's mother-in-law, Sarah Corzine, each owned a half interest in a 363 acre tract of land described as half of a mile north of San Augustine. Perhaps this was part of the land under dispute, or Temple could have just been looking after his and Mrs. Corzine's property. Hershal Corzine, Anderson's young brother-in-law, was probably there also to protect his mother's interest, especially if the 363 acre tract was involved. The four men met the John Bodine party at the corner of (Major] Smith's field-probably the point selected to begin rechecking land lines. There were three in Bodine's ranks, John (an elderly man who had been in poor health for a long time), his thirty-year-old son, Oliver Hazzard, Perry Bodine, and William Nations. Nations' relationship with the Bodine family remains a bit of a mystery even today. Perhaps he was a hired hand, or the foreman of Bodine's plantation. Members of the Horton/Anderson party later claimed the discussion, contesting the position of property lines, began in a friendly manner. But at some point, and apparently without much delay in the rendezvous turned into a gunfight. Several shots reverberated across the Ayish Bayou bottom. John Bodine and William Nations were killed on the spot. Young Bodine escaped injury-either absent at the time, having been sent on a short en-and, or he had high-tailed it out of range at the first sign of gunplay. Almost before the gun smoke had time to drift away, Anderson, Horton, Temple and Corzine headed for San Augustine to turn themselves in to sheriff William Kimbro. The four men had hardly disappeared down the trail before young Bodine returned to the scene of the shootout to find his father and Mr. Nations lying in the dirt-dead. Two murder indictments were quickly issued against William G. Anderson, Alexander Horton, Lewellyn A. Temple and Hershal Corzine by a San Augustine grand jury-one for the murder of "John" Nations and one for the murder of John Bodine. Consequently, seven months later, on April Fools' Day, 1840, Judge Edward T. Branch ordered thirty-six talismen from which to select a jury in the case of the Republic of Texas vs William G. Anderson, et al for the murder of John Nations. After district attorney James G. Hyde announced he was ready to go to trial and the four defendants issued a plea of "not guilty," Judge Branch ordered a jury impaneled. WilIiam Nash and Wyatt Hanks were the first to be examined and quickly told to "step aside." The selection process continued for the rest of the day but by late afternoon the twelve seats had been filled and a "...jury elected and sworn to try the issue... the balance of the talismen... were discharged and by consent-of-parties the case laid over till morning." The members of the jury were: Thomas N. Cartwright, Thomas D. Hendrick, Alanson W. Canfield, William Daniel, Augustus Phelps, Edwin O. LeGrand, George A. Nixon, Charles W. Crouch, William W. Parker, Presley J. Loggins, William M. Hunt and Richard O. Brown. Before Judge Branch adjourned for the night, however, he took care of a final piece of business, ordering a fine of $10.00 against Matthew Cartwright for failing to appear as a talisman. The following morning, Friday, April 3rd, court reconvened. As the examination of witnesses progressed it was "...proven to the satisfaction of the court that the individual murdered was named William-not John." Nevertheless, the court agreed to leave the indictment as John Nations but allow the witnesses to refer to the murdered man as William Nations. After that day. After hearing all of the evidence, the jury issued the following statement: "We the jury find the prisoners not guilty as charged In the indictment-W. W. Parker, foreman." The first murder case was over-Anderson, Horton, Temple and Corzine had been found not guilty in the murder of William [John] Nations. Again, before court was adjourned, Judge Branch did a little housekeeping. He ordered $100.00 fines against each of three defaulting witnesses, Horatio M. Hanks, John L. Smith and Samuel T. Burns. Witnesses, Horatio M. Hanks, John L. Smith and Samuel T. Bums. Present "good cause" for being absent. The judge accepted their statements and reduced their fines to $10.00. Court was then adjourned for the night. At 9:00 a.m. the following morning, Saturday, the judge began the second trial against the same four defendants for the murder of John Bodine. After :he four men appeared before the bench to plead "not guilty," the judge promptly ordered a jury to be impaneled. Not being able to complete the jury that day, the judge ordered Sheriff Kimbro to call thirty more talismen for Monday morning. Before adjourning, John L. Smith was able to convince Judge Branch to remit the adjusted $10.00 fine. Examining and seating the jury took nearly all day, Monday, April 6th. The trial finally began. But after taking the testimony of the first two Witnesses, district attorney Hyde made a motion to" ...adjourn till tomorrow morning 9 o'clock and that the sheriff take charge of the jury and procure a room and sustenance during the term of the...trial." The jurors for the second murder trial were: Edwin O. LeGrand, William M. Hunt, William Daniel, Jacob Garrett, Jr, Charles W. Crouch, David F. Webb, Presley J. Loggins, John T. Patterson, Joseph T. Green, James M. Caldwell, George M. Jones and Alfred Polk. Tuesday morning, before calling any witnesses, Judge Branch ordered '...a fine of one hundred dollars to be entered against Horatio Hanks as a defaulting witness (Hanks had failed to testify the previous day). The rest of Tuesday, all of Wednesday and all of Thursday, was filled with the testimony of witnesses. Since Oliver Hazzard Perry Bodine was the only survivor of the Bodine party, he was the foremost witness during the trial. He was interrogated extensively by both the prosecution and the defense. Although records of more than fifty questions put to young Bodine while under oath on the standstill exist, his responses have been lost to time. However, some answers can be inferred by how the next question was phrased or by a shift in the direction of interrogation. For instance, it's clear young Bodine was not at the spot of gunfire when it took place but returned shortly thereafter. Mr. Bodine and Mr. Nations were both killed at the same time, at least they were both dead when young Bodine returned. Mr. Nations had been hit by several bullets or shots. The Anderson/Horton party didn't use pistols-only shotguns and/or rifles. At some point before the shooting actually started Corzine had held a gun on young Bodine for several minutes. Mr. Nations had a gun, perhaps the only weapon in the Bodine party. Unfortunately, the precise sequence of events, the exact number of shots exchanged, if in fact, the Bodine party even fired, has been lost to time and will remain an Ssue of uncertainty forever. By late Thursday interrogation of all witnesses had been completed. Friday morning began with the argument of counsels. Hyde presented the prosecution's case first with assistance from David S. Kaufman and George W. Terrell. This was followed by the argument for the defense presented by Richardson Scurry, James S. Mayfield, William C. Duffield, Ezekiel W. Cullen and James Pickney Henderson. (Although court records failed to confirm this point, it's almost a certainty these same five attorneys provided the 4eFense in the first trial.) Court reconvened an hour earlier on Saturday morning-eight o' clock sharp. After final arguments were completed the case was given to the jury. Records do not indicate the length of deliberation, led by foreman Edwin O. LeGrand, but eventually the twelve men returned with a verdict: "We the jury find that the defendants are not guilty in manner and form ' as alleged in the indictment." Once again the Anderson/Horton party was found not guilty-this time for the murder of John Bodine. Eight months and one day after John Bodine and William Nations were gunned down near the corner of Smith's field, Anderson, Horton, Temple and Corzine were free to walk the streets of San Augustine-found innocent by a jury of their peers. Unknown to Temple, a San Augustine farmer, he would die of natural causes at his home five months later. September 5. 1840. In later years, Alexander Horton wrote about the Bodine/Nations killing. His notes, found in an old business ledger, gave his view of the outcome: "I was tried for my life in company with Lew Allen Temple, Hershal Corzine and W. G. Anderson for having been compelled to kill William Nations and John Bodine. This unfortunate occurrence was brought on by their own rashness to the great mortification of all and has left a lasting impression on my mind which time alone can't obliterate, for tho I was justified in this, I lament so great a misfortune. Public opinion was great against us, but we were honorably acquitted...My friends should ...remember the generous and kind conduct of Mr. Kimbro and Thomas Payne, Deputy. They were kind but did their duty. My friends should never forget William and John Nash who stood by with arms in their hands to fight and die with us or see us rescued in case a verdict went against us..."
